Dozens of kilos of confidential papers still lie in the offices. HR memos, bank statements, legal files, internal correspondence… They don’t all have to be kept indefinitely. But how can we ensure that their disposal complies with both legislation and confidentiality requirements? 🔍 Did you know that a company can be penalized for improperly destroying its documents, even out-of-date ones?
Between legal obligations and safety issues
Destroying paper documents is no trivial matter. It must be carried out within a strict regulatory framework:
-
the French Heritage Code, which lays down conservation periods,
-
RGPD, which requires personal data to be deleted after their useful life,
-
protection of sensitive data (medical confidentiality, tax data, contractual elements, etc.).
A document kept beyond its legal duration may expose the organization to sanctions. Conversely, premature or untraceable destruction may be considered a loss of evidence, or even an offence in the event of litigation.
Last but not least, there is the issue of business confidentiality: strategic notes, R&D projects, internal decisions. All these documents, even out-of-date ones, must be treated with the utmost rigor, right up to their final destruction.
How do you organize safe, compliant disposal?
To ensure confidentiality and compliance, destruction must follow several key steps:
-
Identifying documents for disposal: First of all, you need to make sure that the document has reached the end of its legal life, and that it does not need to be preserved.
-
Set up a secure destruction circuit: Don’t just throw sensitive documents in the garbage can! You need a locked container, emptied regularly, or scheduled removal under secure conditions.
-
Use a certified service provider: Specialized companies guarantee industrial destruction (by crushing or shredding) in compliance with DIN 66399 standards, and issue a certificate of destruction.
-
Trace the operation: The destruction slip certifies that the operation has been carried out correctly. It must be kept in the archiving plan as proof in the event of an inspection.
-
Raising team awareness: Confidentiality also depends on behavior: a forgotten file on a printer can be enough to compromise sensitive data. Integrating these reflexes into daily practices is essential.
